  Art. 1

Awarding and organisation of the competition
--------------------------------------------

The awarding of the scholarships of the Napoleon Godecharle Fund, established by the will of 15 March 1871 and intended for sculptors, painters and architects who are "endowed with extraordinary talent" and "give rise to well-founded expectations of wide success", and who are thus able through their works to contribute to making "the artistic fame of Belgium a reality", will take place through a competition called the "Godecharle Competition", established by royal decree of 17 January 1881, in accordance with the following provisions.

The competition is organised every two years, simultaneously for sculpture, painting and architecture, by the Commission for Scholarship Foundations of Brabant (hereinafter referred to as "the Commission") to which, by royal decree of 12 November 1878, the management of the Napoleon Godecharle Fund was entrusted.

Art. 2

Scholarships and special prizes
-------------------------------

The laureates of each of the competitions for sculpture, painting and architecture are awarded a scholarship totalling **€14,000.00**, payable in four instalments. The scholarship must be taken up within four years of the award.

In addition, a special jury prize of **€1,500.00** may be awarded.

If, for any branch of the competition, the jury fails to identify the best candidate, an ex aequo award is permitted. In that case, the awarding of a special jury prize is not permitted. The amount of the scholarships is then set at **€7,750.00 per ex aequo laureate**.

Art. 3

Purpose of the scholarships and prizes
--------------------------------------

The scholarships and special prizes reserved for sculpture and painting are intended to encourage a young sculptor and a young painter and, as desired by the founder, to allow them "to perfect their artistic training by visiting the major institutions abroad".

The scholarship and special prize reserved for architecture are intended to encourage a young architect who, through the various tests to which he will be subjected, will demonstrate that he possesses the necessary technical knowledge and artistic sensibility to respond creatively to the concerns and needs of our time, and to offer him the opportunity to complete his architectural training through internships and research abroad.

However, laureates and beneficiaries may, if they wish, use the amount of the scholarship or prize for a publication, a rental fee, support for an exhibition or a cultural project, rather than for travel and stays abroad.

Art. 4

Organisational costs
--------------------

In addition to the scholarships and prizes awarded to laureates and beneficiaries, the same Fund also covers:

- The costs of organising the competition and the exhibition of works selected by the juries, such as the costs of printing posters and catalogues, publishing press releases or internet announcements, or photographing the works produced by the candidates.
- Travel expenses and fees to be granted to the jury members.

Art. 5

Composition and operation of the juries
---------------------------------------

The Commission shall form three juries, each comprising five members, of which at least four are respectively active as a sculptor, painter or architect.

The reports of the juries will be signed by all jury members and sent to the Commission without delay. Jury members are forbidden to disclose the results of their work to third parties.

Furthermore, the Commission will be represented in each jury by a delegate with advisory vote. The juries can only validly deliberate if at least three members are present during their work.

The Commission shall appoint the chair of each jury from among its members. The chairs shall ensure the proper functioning of the juries and compliance with these regulations.

The chairs will be assisted in their task by a secretary whom the jury members will appoint among themselves at the start of the proceedings. The secretary's task is to prepare, for each test of the competition, a report setting out the work of the jury and the conclusions it has reached.

The jury has the authority to settle any disputes that arise during the two tests of the competition. If necessary, it may seek the advice of the Commission organising the competition.

Both for the preselection of candidates and for the final test, the jury members apply an assessment system that they determine in advance by mutual agreement. This irrevocable assessment system must be communicated to the Commission's delegate prior to each test.

If necessary, decisions of the jury are taken by simple majority. In the event of a tie, the chair's vote is decisive.

Art. 6

Announcement of the competition
-------------------------------

At least six months before the competition, the Commission shall publish a notice announcing the competition in the most appropriate form to reach potential candidates.

Art. 7

Conditions for participation
----------------------------

The competition is reserved for artists who have Belgian nationality or are citizens of one of the countries of the European Union or the European Economic Area, who, at the date of closing of applications, have been living or staying in Belgium for at least two years, who are under thirty-five years old on 1 January of the competition year, and who have not previously been a laureate of the competition.

Art. 8

Registration
------------

Applications to participate in the competition are submitted using electronic registration forms made available by the organising Commission on its website, before the deadline specified in the announcement notice.

They must be accompanied by documents proving that the conditions of nationality, residence or stay, and age required by the founding act of the Godecharle Fund, by these regulations, and by the organic law of 19 December 1864 have been met.

The architecture competition additionally requires possession of the title of architect, proof of which must also be provided.

Art. 9

Documents accompanying the application
--------------------------------------

Along with the application form, submitted in accordance with the provisions of the previous article, candidates must enclose the following:

- A document stating their curriculum vitae.
- For the sculpture and painting competitions, a representative catalogue of their artworks, indicating the representative works of their recent production that they undertake to make available for exhibition if selected by the juries. This involves two works for the sculpture competition and three for participants in the painting competition.
- For the architecture competition, architectural designs, freely chosen by the candidate, or already realised designs, of which the candidate declares on honour that they are the author. Each design is supported by a maximum of ten sketches and possibly an explanatory note of maximum two pages, as well as, in the case of already realised designs, a minimum of four and a maximum of eight photos, as well as the plans, sections, elevations, etc. of these constructions.

Art. 10

Course of the competition
-------------------------

The competition proceeds in six phases:

1. **Registration**, with the candidate's prior written agreement to:

    - these competition rules;
    - the commitment to personally participate in the four dates of the competition;
    - a list of three works that will be available on the exhibition dates.
2. **Preselection:** meeting of the juries, each selecting four candidates to continue the competition.
3. **Beginning of the final phase:** during a period of at most five consecutive days, a theme or subject common to the three sections is addressed.
4. **First presentation** of the work or an interim project to the jury.
5. **Final test** with presentation of artworks and projects and designation of the laureate.
6. **Proclamation** and the start of the exhibition.

Art. 11

Allocation of scholarships and prizes
-------------------------------------

The scholarships and prizes are allocated by the Commission based on the reports of the juries.

If the works selected by the juries for scholarships and prizes and for the exhibition in any way violate the law or in case of fraud, the Commission may refuse to award one or more scholarships or prizes or to proceed with the exhibition of the works concerned.

In other cases, the Commission ratifies the decisions of the juries.

Art. 12

Fraud and exclusion
-------------------

Any candidate who presents another's work as their own is excluded from the competition for which they were registered. They lose all rights to a scholarship, even if it has already been awarded, without prejudice to the application of Article 496 of the Penal Code.

Art. 13

Exhibition and publication of works
-----------------------------------

The Commission reserves the right to exhibit within three months after the juries' decisions:

- The representative catalogues of artworks and the works submitted to the juries.
- The works submitted in application of Article 9.
- The works submitted to the juries of the painting and sculpture competitions.
- The submitted artworks, designs and works of the various competition categories.

Similarly, the Commission reserves the right to make known the works produced by the laureates by all appropriate means, including through various media, without time limit and without special compensation.

Art. 14

Use of the scholarship or prize
-------------------------------

Before being able to dispose of the scholarship or prize, the laureates and beneficiaries of a prize must submit a proposal for use for approval to the Commission.

The Commission will judge whether this proposal aligns with the objectives of the Fund. The laureates and beneficiaries must justify their expenses by submitting supporting documents.

Unless otherwise authorised by the Commission and on pain of losing all rights to the scholarships allocated to them, laureates must fulfil their obligations within four years after notification of the competition results.

Art. 15

Report after travel or project
------------------------------

Within two months after the end of each trip and/or stay abroad or realisation of a project, the laureate or beneficiary must submit to the Commission a detailed report of their trip, exhibition, cultural project or publication and the studies and research carried out.

Art. 16

Payment of the scholarship or prize
-----------------------------------

The laureates and beneficiaries receive their scholarship or prize as follows:

1. One quarter upon submission of the project and its approval by the Commission.
2. One quarter after the laureate or beneficiary communicates the date of departure or the realisation date of their project.
3. One quarter after the laureate or beneficiary provides the required proof of their stay or project.
4. The balance after submitting the foreseen report and supporting documents.

Art. 17

Unallocated scholarships and prizes
-----------------------------------

If one or more scholarships or prizes are not allocated, due to lack of candidates meeting the required conditions, or if the scholarships and prizes are not claimed or not used for the intended purposes, the unallocated income will accrue to the Fund's endowment.

Exceptionally, the Commission may, in accordance with the founder's will, give this income the destination it "deems best in the interest of art".

Art. 18

Liability
---------

The Commission disclaims all liability in case the documents and works submitted for the competition or the artworks sent pursuant to Article 9 are lost or damaged in any way.

The Commission also disclaims all liability for any event whatsoever that would cause damage to the candidates admitted to the final test or to the documents and objects they have in their possession during that test.

Art. 19

Application of the regulations
------------------------------

All difficulties concerning the application of these regulations are settled by the Commission for Scholarship Foundations of Brabant, taking into account the will of the founder, the interest of the Fund and that of the artists, candidates or laureates.
